Terms of Service
Who you are dealing with
This store is operated by Trackday Brand LLC, a Wyoming limited liability company — "we", "us", "our". By placing an order you agree to these terms. Please read them; they are short and they are written to be read.
Eligibility
You need to be old enough to enter a binding contract where you live in order to buy from us.
Orders
An order is an offer to buy. We accept it when we send you a confirmation email. Until then there is no contract.
We may decline or cancel an order — including after confirmation — if an item is unavailable, if there is a pricing or description error on the site, if an edition has sold through, or if we suspect fraud. If we cancel after taking payment, you receive a full refund. We are not able to fulfil an order at an obviously mistaken price.
Once an order has entered production it has been made for you alone and can no longer be cancelled. See our Shipping Policy for how that window works.
Prices
Prices are in US dollars and may change without notice. Shipping is a flat $9.95 per US order, free on orders of $100.00 or more. Sales tax is added at checkout where required.
Made to order
Every item is made to order. Please read our Shipping Policy and Refund Policy before buying — the timelines and the return rights are genuinely different from a store that ships from stock, and we would rather you knew that in advance than found out afterwards.
Editions
Editions are produced in finite numbered runs. When a run is exhausted it is not reproduced. We reserve the right to limit quantities per customer on any edition.
Colour and product accuracy
We photograph everything honestly and we do not retouch prints to look crisper than they are. But printed colour on dyed cotton and embroidery thread matching both carry real manufacturing tolerances, and there are three you should know about before you buy:
- Screen versus cloth. Your monitor is backlit and a garment is not. Colours will not match exactly, and we cannot control how your particular screen is calibrated.
- Batch variation. Print density and thread tone vary slightly between production runs. Two of the same shirt bought months apart may not be identical.
- Deliberately close tones. Some of our designs work a light mark on a light garment, or a dark mark on a dark one. They are meant to read quietly. That restraint is the design decision, not a printing failure.
None of the above is a defect. A genuine production fault — a misprint, a bad embroidery run, damage, or the wrong item — is, and we fix those at our cost. See our Refund Policy.
Intellectual property
The Trackday Brand name, the badge, the interlocking TD monogram, and all designs, photography, and text on this site are our property or are used with permission. You may not reproduce them commercially.
No affiliation
Our editions reference real cars and real racing history. Edition artwork is abstracted to colourway and stripe geometry: it carries no sponsor marks and depicts no identifiable vehicle. We do not claim, and you should not infer, any affiliation with, endorsement by, or sponsorship from any vehicle manufacturer, racing team, driver, series, or circuit. All third-party names and marks that appear anywhere on this site remain the property of their owners and are used only descriptively, to say what a design refers to.
Your content
If you send us photographs or tag us on social media, you keep ownership of your work. We do not take a licence to your images by virtue of you tagging us, and we will not sell your photographs or use them in paid advertising without asking you first.
Tagging a public account is a public act, and we may share or repost tagged posts to our own channels with credit, as is normal practice on those platforms. If you would rather we did not, tell us and we will take it down.
Site use
Please do not attempt to interfere with the site, gain unauthorised access to any part of it, use it to place fraudulent orders, or extract its content in bulk for a competing commercial purpose.
Warranties and liability
We make the promises set out in these terms and in our Shipping and Refund policies, and we stand behind them. Beyond those, the site and the products are provided as they are, and we do not give any further warranty, express or implied, except where the law does not allow us to exclude one.
To the extent the law allows, our total liability to you in connection with any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses. Nothing in these terms limits any right you have under consumer protection law that cannot be limited — and if any part of this section is unenforceable where you live, the rest still applies.
Changes to these terms
We may update these terms. The version in force for your order is the version published when you placed it.
Governing law
These terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws rules. Any dispute arising out of them or out of any order will be brought in the state or federal courts located in Wyoming, and you and we each consent to the jurisdiction of those courts.
Nothing in this section removes any right you have under the consumer protection laws of the state where you live.
